AI Buddy Terms of Use

1. Acceptance of Terms

By using AI Buddy, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent to use the app.

We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the updated Terms.

Acceptable Use

You agree to use AI Buddy only for lawful purposes and in accordance with these Terms. You will not:

• Use the app to generate or share harmful, offensive, or inappropriate content
• Attempt to reverse engineer, hack, or compromise the app's security or encryption
• Use the app for commercial purposes without explicit permission
• Attempt to manipulate, abuse, or exploit the AI system or crisis detection features
• Share content that contains hate speech, threats, illegal content, or self-harm instructions
• Impersonate others or provide false information about crisis situations
• Use the app in ways that could harm other users or interfere with the service

5. Crisis Detection and Support

User Agreement for Crisis Features

By using AI Buddy, you acknowledge and agree that:

• Crisis detection is automated and may not catch all crisis situations
• You will contact emergency services (911) or crisis hotlines for immediate help when needed
• AI Buddy's crisis detection supplements but does not replace human judgment
• You understand the limitations of automated crisis detection technology
• You will not misuse or test crisis detection features unnecessarily

6. Intellectual Property

App Ownership

AI Buddy, including its AI models, design, code, crisis detection algorithms, and features, is owned by Darkmaster's Pottery and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the app for personal wellness purposes.

Your Content

You retain ownership of your conversations and personal information shared with AI Buddy. However, you grant us a limited license to:

• Process your conversations through our AI systems to provide support
• Use anonymized, aggregated data to improve crisis detection and wellness features
• Store encrypted conversation history to provide personalized support
• Share anonymized crisis patterns with mental health research organizations (with your consent)

7. AI Technology and Limitations

• AI Accuracy: AI responses may not always be perfect or contextually appropriate for your situation
• Crisis Detection: Automated systems may not detect all crisis situations or may occasionally produce false positives
• Service Availability: The app may experience downtime for maintenance or technical issues
• Feature Changes: We may update, modify, or discontinue features to improve safety and effectiveness
• Performance: App performance may vary based on device capabilities and network conditions
• Multi-Provider System: AI responses come from multiple providers with automatic fallbacks

We continuously work to improve our AI technology and crisis detection capabilities, but you acknowledge that artificial intelligence has inherent limitations and may occasionally produce unexpected results or miss important context.

8. Disclaimers and Limitations

Limitation of Liability

To the maximum extent permitted by law, Darkmaster's Pottery shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of AI Buddy, including but not limited to damages from:

• Missed crisis detection or false crisis alerts
• Inappropriate AI responses or advice
• Technical failures during critical moments
• Decisions made based on AI interactions
• Mental health outcomes or treatment decisions

9. Subscription and Payments

AI Buddy may offer premium features through in-app purchases or subscriptions. All purchases are processed through the Apple App Store.

• Subscription fees are charged in advance and are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage subscriptions through your Apple ID account settings
• Premium features may include enhanced AI capabilities, advanced analytics, or additional crisis resources
• Core safety and crisis features remain available regardless of subscription status

10. Termination

We may terminate or suspend your access to AI Buddy at any time for violations of these Terms, misuse of crisis features, or other reasonable causes. You may discontinue use of the app at any time by deleting it from your device.

Upon termination, your right to use the app ceases immediately. Your encrypted data will be deleted according to our data retention policies, though provisions regarding intellectual property, disclaimers, and limitations of liability shall survive.
